These terms apply to every order placed with TAPL Office Furniture. If anything here is unclear, just call and ask before you order. We would rather explain it now than disagree about it later.
These terms, and who we are
These terms cover all goods and services that TAPL Office Furniture sells to you. They apply to orders you place on this website, in either showroom, by phone, by email, or from a quotation we have sent you.
When you place an order, you accept these terms. Nothing in them takes away the rights Kenyan law gives you as a consumer.
Quotations and prices
A quotation is valid for thirty days from the date we send it, unless the quotation says otherwise. After that, we may need to give you a new price. This is most likely for imported items, because exchange rates move.
Prices on this site are in Kenya Shillings and include VAT at 16%. The VAT amount is shown on its own in your cart and on every quotation and invoice.
We take care to keep prices on the site correct. If a price is clearly wrong, we will contact you before we accept the order. You can then go ahead at the correct price, or cancel and get a full refund.
Delivery and installation are priced on their own lines in every quotation, not hidden in the furniture price.
Orders, and when a contract starts
Your order is an offer to buy. The contract starts when we confirm your order, or when we take your payment, whichever comes first. Until then, we may turn down an order. For example, if an item is no longer available, or there has been a clear mistake.
When we confirm your order, we will tell you which items are in stock and which need to be brought in or built.
Payment
We accept cash, M-Pesa, card and bank transfer. You pay on a secure page run by our payment provider. We never see or store your card or mobile money details.
For stock items, you pay in full when you order. For made-to-order and custom items, you pay a deposit of 50% when you approve the drawing. You pay the rest before delivery.
Companies and institutions with an account may be given credit terms. If an invoice is not paid by the agreed date, we may stop further deliveries and charge interest at the rate the law allows.
Delivery
We agree a delivery date with you. We do not send goods out without notice. Stock items usually leave our warehouse within three working hours of the order being completed. But the delivery date is the date we agree together.
We give delivery dates honestly, and we work hard to meet them. But they are estimates, not promises. We are not responsible for delays outside our reasonable control. See Events outside our control.
Before delivery, you must tell us about anything that could make access hard: lift sizes, stairs, security checks, parking, and any notice the building manager needs. If we cannot complete a delivery because access was not as you described, we may charge you for a return visit.
Risk passes to you on delivery. That means from then on, you are responsible if the goods are lost or damaged. Title, meaning ownership, passes to you only when we have received payment in full.
Assembly and installation
Assembly is included on every order we deliver. It costs nothing extra. Our team puts the items together in the room they belong in, and takes the packaging away.
Assembly is not included if you collect from a showroom.
When we fit out a whole floor, we plan the dates with you. If the space is in use, we can work in the evening or at weekends. You agree to give us safe access, working lights and power, and a clear area to work in.
Custom and made-to-order items
Custom pieces are built to a drawing you approve. The price is fixed before we start building. Most items take three to five weeks from the day you approve the drawing.
These items are made just for you, so they cannot be returned or cancelled once we have started building them. The only exceptions are if they are faulty, or do not match the drawing you approved.
Wood and veneer vary naturally in grain and colour. Finishes can also differ slightly from one batch to the next. We match as closely as the material allows. If an exact match matters to you, we will send a sample for you to approve first.
Changes, cancellations and returns
You can change or cancel an order for free until we reserve stock or start building. After that, it depends on the item:
| Item | Can it be cancelled? | Can it be returned? |
|---|---|---|
| Stock items, unused and unassembled | Yes, before it leaves us | Yes, within 7 days, in the original packaging |
| Stock items, assembled and installed | Yes, before it leaves us | Only if we agree. We may charge to collect it |
| Made-to-order items | Yes, before we order it from the manufacturer | Only if faulty |
| Custom-built pieces | Yes, before we start building | Only if faulty or not as drawn |
We refund you the same way you paid, within fourteen days of agreeing the return.
None of this takes away your rights if goods are faulty, not as described, or not fit for their purpose.
Damage, missing items and faults
Our own team delivers and installs. If anything is damaged or missing, please tell our team on site before they leave, or call us the same day. If an item was damaged on the way to you, we replace it at our own cost.
If a fault shows up later, send a photo to your named account contact. We will arrange to inspect it, and repair or replace it as described in the next section.
After-sales support
We support every item we sell after the sale. If a fault in how an item was made shows up in normal office use, tell your named contact. We will inspect it, and repair or replace it where the fault is ours.
Any warranty on a particular item is agreed as part of the sale and stated on your quotation. It does not cover normal wear and tear, misuse, accidental damage, changes made without our permission, use beyond the weight a product is rated for, or use for a purpose it was not meant for.
We keep spare parts for the items we sell in Nairobi. So most problems are fixed by replacing a part, not the whole item.
What we are responsible for
We are responsible for loss or damage you suffer because we broke these terms, or did not use reasonable care and skill. This applies where the loss was foreseeable, meaning it could reasonably have been expected.
We do not limit or exclude our responsibility where the law does not allow it. This includes death or personal injury caused by our negligence, and fraud.
We are not responsible for business losses that could not have been expected when the contract started. Examples are lost profit, lost business, or savings you expected but did not get. Unless the law says otherwise, the most we will pay for any order is the price you paid for that order.
Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control. These include shipping and port delays, customs action, extreme weather, civil unrest, strikes, or cuts to power, phone or internet.
If this happens, we will contact you as soon as we can and agree a new date. If the delay is a long one, you may cancel the part of the order that is affected. We will refund anything you paid for that was not delivered.
Who owns drawings and website content
Drawings, layouts and specifications we prepare belong to us until the order they relate to is paid in full. After that, you may use them freely for the premises they were made for.
Everything on this website, including the text, photos and design, belongs to TAPL Office Furniture. You may not copy it without our permission.
Which law applies, and disputes
The laws of Kenya apply to these terms. Any dispute about them goes to the courts of Kenya.
Before it gets to that, please talk to us. Most disputes are a mix-up about a date or a detail. A phone call to your named contact sorts them out faster than anything formal.
Changes to these terms, and contacting us
We may update these terms. The version that applies to your order is the one on this page when we confirmed your order. The date at the top of this page shows when the terms were last changed.
To reach us: info@taploffice.com, +254 793 937 924 or +254 710 553 671, or visit either showroom (T-Mall Area, Nairobi West, or The Mirage, Waiyaki Way, Westlands).
Quotations are valid for thirty days. Prices include VAT and assembly. We agree delivery dates with you. We do not just send things out. You can return stock items within seven days if unused. You cannot return custom pieces, because they were made for you. We keep spare parts in Nairobi.
